These Terms of Service ("Terms") govern your access to and use of the CreatorCraft Academy website, courses, and services (collectively, the "Services"). Please read these Terms carefully before using our Services.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
1. Account Registration
To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information and to keep this information updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you are at least 18 years old.
2. Course Enrollment and Payment
2.1 Enrollment: When you enroll in a course, you gain access to the course materials for the duration specified at the time of enrollment. Access to course materials may be limited to a specific time period.
2.2 Fees and Payment: The fees for our courses are as stated on our website at the time of enrollment. All fees are in Euros (€) and are non-refundable except as expressly provided in these Terms.
2.3 Payment Methods: We accept payment through the payment methods specified on our website. You agree to provide accurate and complete payment information. By submitting payment information, you authorize us to charge the designated payment method for the full amount of the transaction.
2.4 Refund Policy: We offer a 7-day refund policy for our courses. If you are dissatisfied with a course, you may request a refund within 7 days of enrollment, provided you have not accessed more than 25% of the course materials. Refund requests must be submitted in writing, and refunds will be processed within 14 business days.
3. Intellectual Property Rights
3.1 Our Content: All content included in or made available through our Services, including text, graphics, logos, images, videos, and course materials (collectively, "Content"), is owned by or licensed to CreatorCraft Academy and is protected by intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works based upon our Content without our express written permission.
3.2 Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services and Content for your personal, non-commercial educational purposes. This license does not include the right to: (a) resell or commercially use our Services or Content; (b) distribute, publicly perform, or publicly display any Content; (c) modify or otherwise make any derivative uses of our Services or Content; or (d) use any data mining, robots, or similar data gathering methods.
3.3 Student Work: You retain ownership of any content you create and submit as part of our courses ("Student Work"). By submitting Student Work, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, distribute, modify, and display your Student Work for educational, promotional, and operational purposes related to our Services.
4. Prohibited Conduct
You agree not to:
- Use our Services for any illegal purpose or in violation of any applicable laws
- Share your account credentials or course access with others
- Interfere with or disrupt the operation of our Services
- Attempt to gain unauthorized access to our Services or systems
- Engage in any activity that could damage, disable, or impair our Services
- Collect or harvest any information from our Services
- Upload or transmit viruses, malware, or other harmful code
- Post or transmit any content that is unlawful, fraudulent, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Infringe upon the rights of others, including intellectual property rights
5. Student Conduct and Community Guidelines
5.1 Respectful Interaction: You agree to interact with instructors and other students in a respectful and professional manner. Harassment, discrimination, and offensive behavior will not be tolerated.
5.2 Academic Integrity: You agree to maintain academic integrity by submitting original work, properly citing sources, and refraining from plagiarism or cheating.
5.3 Feedback and Reviews: When providing feedback or reviews about our courses, you agree to provide honest, constructive, and respectful comments.
6. Termination
6.1 Termination by You: You may terminate your account at any time by contacting us. Termination of your account does not entitle you to a refund.
6.2 Termination by Us: We reserve the right to suspend or terminate your access to our Services at our sole discretion, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to access and use the Services will immediately cease.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that: (a) the Services will be secure or available at any particular time or location; (b) any defects or errors will be corrected; (c) the Services are free of viruses or other harmful components; or (d) the results of using the Services will meet your requirements.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATORCRAFT ACADEMY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
9. Indemnification
You agree to indemnify, defend, and hold harmless CreatorCraft Academy and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your Student Work caused damage to a third party.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or our Services shall first be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be finally resolved by arbitration in accordance with the rules of the Cyprus Arbitration and Mediation Centre.
11. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of these Terms and notify you through the Services or by other means. Your continued use of the Services after the changes have been posted constitutes your acceptance of the revised Terms.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CreatorCraft Academy regarding our Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning our Services.
